Les appels du Procureur général du Québec et de B interjetés contre l'arrêt de la Cour d'appel du Québec (Montréal), numéro 500-09-019939-099, 2010 QCCA 1978, en date du 3 novembre 2010, entendus le 18 janvier 2012, sont accueillis et l'appel de A est rejeté, sans dépens dans tous les cas. Les articles 401 à 430, 432, 433, 448 à 484 et 585 du Code civil du Québec, L.Q. 1991, ch. 64, sont constitutionnels. Les juges Deschamps, Cromwell et Karakatsanis sont dissidents en partie quant au résultat et la juge Abella est dissidente quant au résultat.
Les questions constitutionnelles reçoivent les réponses suivantes :
1. Les articles 401 à 430, 432, 433, 448 à 484 et 585 du Code civil du Québec, L.Q. 1991, ch. 64, contreviennent-ils au par. 15(1) de la Charte canadienne des droits et libertés?
Réponses :
La juge en chef McLachlin et les juges Deschamps, Abella, Cromwell et Karakatsanis : Oui.
Les juges LeBel, Fish, Rothstein et Moldaver : Non.
2. Dans l'affirmative, s'agit-il d'une limite raisonnable prescrite par une règle de droit dont la justification peut se démontrer dans le cadre d'une société libre et démocratique au sens de l'article premier de la Charte canadienne des droits et libertés?

Les juges LeBel, Fish, Rothstein et Moldaver : Il n'est pas nécessaire de répondre à cette question.
La juge en chef McLachlin : Oui.
Les juges Deschamps, Cromwell et Karakatsanis : Seul l'art. 585 n'est pas justifié au sens de l'article premier.
La juge Abella : Non.
The appeals of the Attorney General of Quebec and B from the judgment of the Court of Appeal of Quebec (Montréal), Number 500-09-019939-099, 2010 QCCA 1978, dated November 3, 2010, heard on January 18, 2012, are allowed and the appeal of A is dismissed, without costs in all cases. Articles 401 to 430, 432, 433, 448 to 484 and 585 of the Civil Code of Québec, S.Q. 1991, c. 64, are constitutional. Deschamps, Cromwell and Karakatsanis JJ. are dissenting in part in the result and Abella J. is dissenting in the result.
The constitutional questions are answered as follows:
1. Do arts. 401 to 430, 432, 433, 448 to 484 and 585 of the Civil Code of Québec, S.Q. 1991, c. 64, infringe s. 15(1) of the Canadian Charter of Rights and Freedoms?
Answers:
McLachlin C.J. and Deschamps, Abella, Cromwell and Karakatsanis JJ: Yes.
LeBel, Fish, Rothstein and Moldaver JJ.: No.
2. If so, is the infringement a reasonable limit prescribed by law that can be demonstrably justified in a free and democratic society under s. 1 of the Canadian Charter of Rights and Freedoms?
Answers:
LeBel, Fish, Rothstein and Moldaver JJ.: It is not necessary to answer this question.
McLachlin C.J.: Yes.
Deschamps, Cromwell and Karakatsanis JJ: Only art. 585 cannot be justified under s. 1.
Abella J.: No.
